1. Agreement to Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you and ADHD Harmony B.V. ("ADHD Harmony," "we,""our," or "us"), a private limited company registered in the Netherlands (KvK 99768070), governing your access to and use of:

• Harmony AI: Our AI-powered productivity and wellness application at app.adhdharmony.com and our companion mobile application
• ADHD Harmony Program: Our educational content, community, and coaching services
• Related Services: Our website at adhdharmony.com and any associated services

(collectively, the "Service").

By accessing or using the Service, you agree to be bound by these Terms. If you do not agree to these Terms, you may not access or use the Service.

2. Description of Service

Harmony AI is an AI-powered productivity and wellness application designed specifically for individuals with ADHD. The Service provides:

2.1 Core Features

• AI Chat Assistants: AI agents for coaching, knowledge, and support, available through text and voice
• Daily Check-ins: Track mood, energy, focus, and activities over time
• Worksheets & Tools: Guided exercises based on evidence-based practices
• Personal Library: Knowledge base for storing documents, notes, and insights
• Body Doubling & Focus Sessions: AI companion and community features for focus and accountability
• Tasks: Task management designed for ADHD brains

2.2 Optional Integrations

• Google Tasks: View and manage your tasks within the app
• Google Calendar: View your schedule and create events

2.3 Program Components

As part of the ADHD Harmony program, you may also have access to:

• Educational content and resources on Skool
• Community discussions and peer support
• Live group coaching calls

Feature availability depends on your membership level, and some features may be offered as previews or betas that can change or be withdrawn (see Section 16).

3. Eligibility

To use our Service, you must:

• Be at least 18 years old. The Service is for adults only and is not directed at minors. We may suspend or terminate any account we reasonably believe belongs to a person under 18
• Have legal capacity to enter into a binding agreement
• Not be prohibited from using the Service under applicable laws

By using the Service, you represent and warrant that you meet these eligibility requirements.

4. Account Registration

To access certain features of the Service, you must register for an account. When you register, you agree to:

• Provide accurate information: All registration information must be accurate, current, and complete
• Maintain your information: Promptly update your account if any information changes
• Keep your credentials secure: You are responsible for maintaining the confidentiality of your password
• Notify us of unauthorized access: Immediately inform us of any unauthorized use of your account
• Accept responsibility: You are responsible for all activities that occur under your account

You may not share your account credentials with others or allow others to access your account.

5. Program, Payments, and Refunds

5.1 Program Access

Access to the Harmony AI platform and ADHD Harmony program features is provided based on your membership level. Features and access may vary based on your membership. Purchases may be processed through third-party platforms or payment providers; the price, billing cycle, and any renewal terms are always stated at the point of purchase.

5.2 Lifetime Access

Where "lifetime access" is offered, this means for as long as the program and platform exist in their current or substantially similar form. We reserve the right to modify, update, or discontinue features with reasonable notice.

5.3 Refund Policy

We offer a satisfaction guarantee for our program. If you complete the program as directed and don't feel it brought you value, you may request a refund within the guarantee period stated at purchase. Refund eligibility may require demonstration of program engagement. Contact info@adhdharmony.com for refund requests. This guarantee is in addition to, and does not limit, your statutory rights.

5.4 EU/UK Consumers: Right of Withdrawal

If you are a consumer in the EU/EEA or UK, you have a statutory right to withdraw from a distance purchase within 14 days without giving a reason. For digital services and digital content delivered immediately, you may be asked at purchase to expressly consent to immediate performance and acknowledge that you thereby lose the right of withdrawal once the service has been fully performed (or, for digital content, once delivery has begun). Where the right of withdrawal applies, exercise it within 14 days of purchase by emailing info@adhdharmony.com with an unequivocal statement that you withdraw from the purchase. We will refund you within 14 days of receiving your withdrawal, using the same payment method you used.

5.5 Renewals and Cancellation

If your membership renews automatically, we (or the platform through which you purchased) will make the renewal terms clear before you commit and remind you as required by law. You can cancel at any time with effect from the end of the current billing period by emailing info@adhdharmony.com or using the cancellation option offered at your place of purchase. For consumers in the Netherlands and the EU, after any initial term, notice periods will never exceed one month.

6. AI Service Terms

6.1 AI Disclosure

Our AI agents provide:

• General productivity and wellness coaching
• Information about ADHD and related topics
• Guidance through coaching questions
• Help navigating the platform

6.2 Not Therapy or Medical Care

The Service provides self-help coaching and educational tools only. It is not therapy, counseling, psychotherapy, psychiatric care, or any other form of licensed mental health or medical treatment, and it is not marketed or intended as a substitute for any of these. No therapist-client, doctor-patient, or other professional relationship is created by your use of the Service. Our AI agents are not licensed professionals and are expressly instructed not to diagnose conditions, prescribe or adjust medication, or provide treatment. If you need mental health treatment, please consult a licensed professional. See also Section 10 (Health Disclaimer).

6.3 AI Limitations and Your Responsibility

You acknowledge and agree that:

• AI responses are generated by machine learning models and may be inaccurate, incomplete, outdated, or inappropriate for your situation ("hallucinations" can occur)
• AI cannot replace professional medical, psychological, financial, or legal advice
• AI responses are for informational and coaching purposes only
• You should independently verify any important information provided by AI before relying or acting on it
• You remain solely responsible for your decisions and actions, including any actions you take based on AI output
• AI performance may vary and is not guaranteed

6.4 Crisis Safety Protocols

Our AI includes safety protocols designed to recognize expressions of crisis, self-harm, or suicidal ideation and to respond by referring you to crisis resources such as local emergency services, the 988 Suicide & Crisis Lifeline (US), and findahelpline.com. These protocols are a safety measure, not a monitoring or alert service: the Service is not monitored in real time by humans, and you must not rely on it in an emergency (see Section 10.3). You can report concerning AI output at any time via the in-app feedback option.

6.5 No AI Training on Your Data

We do not use your personal data, conversations, or uploaded content to train AI models. Your data is processed solely to provide you with responses and features. See our Privacy Policy for details.

6.6 Content Moderation

Our AI includes safety measures and will not provide harmful content, medical prescriptions, or encourage dangerous activities. The AI may decline to respond to certain requests.

6.7 Body Doubling Sessions

When you participate in body doubling sessions (video or audio calls with other users or AI companions), you acknowledge and agree to the following:

Privacy

• ADHD Harmony does not record body doubling sessions. Audio and video are transmitted in real-time and are not stored by the platform.
• Other participants can see and hear you during the session. By joining a session, you consent to the real-time transmission of your audio and video to other participants.
• While we prohibit recording by participants, we cannot technically prevent screen recording by other users using their own devices.

Conduct

• You will not record, screenshot, or capture other participants without their explicit prior consent
• You will not share or distribute any recordings of sessions
• You will treat all participants with respect and maintain a supportive environment
• You will not engage in harassment, discrimination, or inappropriate behavior during sessions

Limitations

• We are not responsible for the behavior, statements, or actions of other participants
• Session quality depends on your internet connection and device capabilities
• We reserve the right to terminate access for users who violate these terms

7. Third-Party Integrations

The Service offers optional integration with third-party services, including Google Tasks and Google Calendar. By connecting these services:

• You authorize access: You grant us permission to access and use data from these services as described in our Privacy Policy
• Third-party terms apply: Your use of third-party services is governed by their respective terms and privacy policies
• You can disconnect anytime: You may revoke access through your account settings or the third-party's settings
• We're not responsible: We are not liable for the availability, accuracy, or functioning of third-party services

Optional features based on third-party data (such as Human Design insights generated from your birth data) are provided for reflection and entertainment purposes and are not scientific, medical, or professional advice.

8. Acceptable Use

You agree to use the Service only for lawful purposes. You shall not:

8.1 Prohibited Activities

• Use the Service for any illegal purpose or in violation of any laws
• Attempt to gain unauthorized access to the Service or its systems
• Interfere with or disrupt the Service, servers, or networks
• Transmit viruses, malware, or other harmful code
• Collect or harvest user data without authorization
• Impersonate any person or entity
• Use the Service to harass, abuse, or harm others
• Upload content that is illegal, harmful, or violates others' rights

8.2 Prohibited Uses of AI

• Attempt to manipulate, jailbreak, or bypass AI safety measures
• Use AI for illegal purposes or to generate harmful content
• Misrepresent AI responses as professional advice
• Present AI-generated output as human-created where this would mislead others
• Use automated systems to exploit the AI service

8.3 Commercial Use Restrictions

• You may not reproduce, duplicate, copy, sell, or resell any part of the Service
• You may not use the Service to develop competing products
• You may not scrape or extract data from the Service for commercial purposes

9. Intellectual Property

9.1 Our Rights

The Service and its original content, features, and functionality are owned by ADHD Harmony and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws. This includes:

• The Harmony AI platform and its design
• AI agent personas, prompts, and frameworks
• Educational content and program materials
• Logos, branding, and visual assets

9.2 Your Content

You retain ownership of any content you submit, post, or display through the Service ("Your Content"), including:

• Documents you upload to your library
• Notes and reflections you create
• Messages you send to AI agents
• Check-in and worksheet responses

By submitting Your Content, you grant us a worldwide, non-exclusive, royalty-free license to use, reproduce, and process Your Content solely for the purpose of providing the Service to you, including processing by AI to generate responses and insights. For clarity: Your Content is not used to train, improve, or develop AI models."Improving the Service" refers only to technical improvements such as bug fixes and performance enhancements, not the use of your content as training data.

9.3 AI-Generated Content

Content generated by our AI in response to your inputs may be used by you for personal purposes. You may not claim ownership of or copyright in AI-generated content or use it for commercial purposes without our consent.

9.4 Feedback

If you send us suggestions, ideas, or feedback about the Service, you grant us the right to use them without restriction or compensation. This does not apply to Your Content, only to suggestions about the Service itself.

10. Health Disclaimer

10.1 Not Medical Advice

The Service:

• Does NOT provide medical advice, diagnosis, or treatment
• Is NOT therapy, counseling, or psychotherapy, and is NOT a substitute for professional medical care, mental health treatment, or therapy
• Is NOT a substitute for advice from a psychiatrist, psychologist, or other licensed professional
• Should NOT be used to make decisions about medication, treatment plans, or health conditions
• Does NOT create any professional-client relationship between you and ADHD Harmony

10.2 Seek Professional Help

Always seek the advice of your physician, psychiatrist, or other qualified health provider with any questions you may have regarding ADHD or any other medical or mental health condition. Never disregard professional medical advice or delay seeking it because of something you have read or experienced through the Service.

10.3 Crisis Situations

If you are experiencing a mental health crisis, suicidal thoughts, or emergency, please:

• Contact emergency services immediately (112 in EU, 911 in US)
• Call a crisis helpline (988 in US, or find your local helpline at findahelpline.com)
• Reach out to a trusted person

Do not rely on AI or this Service in emergency situations. The Service is not monitored in real time and cannot contact emergency services on your behalf.

10.4 No Guaranteed Outcomes

Coaching outcomes vary from person to person. Any results, improvements, or experiences described in our materials or shared by other members are individual examples and are not a promise or guarantee of your results.

11. Data and Privacy

Your privacy is important to us. Our collection and use of personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference.

Key points:

• We use AI to process your data to provide the Service
• We do NOT train AI models with your data
• We do NOT sell your personal data, and we do NOT share your health-related data or AI inputs with third parties for advertising purposes
• You can request deletion of your data at any time
• We comply with the GDPR and other applicable privacy laws worldwide

12. Disclaimer of Warranties

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that:

• The Service will be uninterrupted, timely, secure, or error-free
• The results obtained from using the Service will be accurate or reliable
• AI responses will be accurate, complete, or appropriate for your situation
• Any errors in the Service will be corrected
• Third-party integrations will function without interruption

If you are a consumer, this section does not limit any statutory warranties or conformity rights that cannot be excluded under the law of your country of residence.

13. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, ADHD HARMONY SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

• Your use of or inability to use the Service
• Any unauthorized access to or use of our servers or your personal information
• Any interruption or cessation of transmission to or from the Service
• Any bugs, viruses, or other harmful code transmitted through the Service
• Any errors, inaccuracies, or omissions in AI-generated content
• Any actions taken or not taken based on Service content or AI responses
• Third-party service interruptions or failures
• The conduct of other users, online or offline

OUR TOTAL AGGREGATE LIABILITY ARISING OUT OF OR RELATING TO THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE SERVICE IN THE 12 MONTHS PRECEDING THE CLAIM, OR €100, WHICHEVER IS GREATER.

Nothing in these Terms excludes or limits our liability for damage caused by our intent or deliberate recklessness (opzet of bewuste roekeloosheid), for death or personal injury caused by our negligence, for fraud, or for any other liability that cannot be excluded or limited under applicable law. Some jurisdictions do not allow limitation of liability for certain damages; in such jurisdictions, our liability is limited to the maximum extent permitted by law, and mandatory consumer protections remain unaffected.

14. Indemnification

You agree to defend, indemnify, and hold harmless ADHD Harmony and its officers, directors, employees, contractors, and agents from and against any claims, liabilities, damages, losses, costs, and expenses (including reasonable legal fees) arising out of or in any way connected with:

• Your access to or use of the Service in breach of these Terms
• Your violation of these Terms
• Your violation of any third-party rights
• Your Content uploaded or submitted to the Service
• Your misuse of AI features or outputs

If you are a consumer, this indemnity applies only to the extent permitted by the mandatory consumer protection laws of your country of residence.

15. Termination

15.1 Termination by You

You may delete your account at any time through your account settings or by contacting us at info@adhdharmony.com.

15.2 Termination by Us

We may terminate or suspend your account and access to the Service immediately, without prior notice or liability, if you materially breach these Terms, if required by law, or if we discontinue the Service. Where reasonably possible and lawful, we will give you notice and an opportunity to export your data first.

15.3 Effect of Termination

Upon termination:

• Your right to use the Service will immediately cease
• We may delete your account data in accordance with our Privacy Policy
• Provisions that by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, indemnity, and limitations of liability

16. Changes to the Service and These Terms

16.1 Changes to the Service

We are continuously improving the Service and may add, change, or remove features, including preview or beta features, at any time. If a change materially reduces the core functionality you paid for, we will notify you in advance where reasonably possible, and you may terminate your membership and receive a pro-rata refund of any prepaid, unused fees.

16.2 Changes to These Terms

We reserve the right to modify these Terms at any time. We will notify you of any changes by:

• Posting the new Terms on this page
• Updating the "Last updated" date
• Sending you an email notification for material changes (if you have an account), with reasonable advance notice before they take effect

Your continued use of the Service after any changes constitutes acceptance of the new Terms. If you do not agree to the modified Terms, you must stop using the Service and may terminate your account.

17. Governing Law and Dispute Resolution

17.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Netherlands, without regard to its conflict of law provisions.

17.2 Dispute Resolution

Any disputes arising under these Terms shall first be attempted to be resolved through good faith negotiations. If resolution cannot be reached within 30 days, disputes shall be submitted to the competent courts of the Netherlands. If you are a consumer residing in the EU/EEA, you may also bring proceedings in the courts of your country of residence, and you always retain the protection of the mandatory laws of that country.

17.3 Consumer Rights

If you are a consumer, you benefit from all mandatory consumer protection provisions of your country of residence. Nothing in these Terms limits or excludes those statutory rights, and in the event of a conflict, your statutory rights prevail.

17.4 Severability

If any provision of these Terms is held to be unenforceable or invalid, such provision will be modified to the minimum extent necessary, and the remaining provisions will continue in full force and effect.

17.5 Entire Agreement; Assignment; No Waiver

These Terms, together with our Privacy Policy and Cookie Policy, constitute the entire agreement between you and ADHD Harmony regarding the Service. We may assign these Terms in connection with a merger, acquisition, or sale of assets; you may not assign them without our consent. Our failure to enforce any provision is not a waiver of our right to do so later.

17.6 Force Majeure

We are not liable for any delay or failure to perform resulting from causes beyond our reasonable control, including acts of nature, war, terrorism, riots, labor conditions, power or internet failures, and failures of third-party providers.

17.7 Accessibility
