• Related Services: Our website at adhdharmony.com and any associated services

(collectively, the "Service").

By accessing or using the Service, you agree to be bound by these Terms. If you do not agree to these Terms, you may not access or use the Service.

2. Description of Service

Harmony AI is an AI-powered productivity and wellness application designed specifically for individuals with ADHD. The Service provides:

• AI Chat Assistants: Multiple AI agents (Sage, Coach, Guide) for coaching, knowledge, and support
• Daily Check-ins: Track mood, energy, focus, and activities over time
• Worksheets & Tools: Guided exercises based on evidence-based practices
• Personal Library: Knowledge base for storing documents, notes, and insights
• Body Doubling: AI companion and community features for focus and accountability

2.2 Optional Integrations

• Google Tasks: View and manage your tasks within the app
• Google Calendar: View your schedule and create events

2.3 Program Components

As part of the ADHD Harmony program, you may also have access to:

• Educational content and resources on Skool
• Community discussions and peer support
• Live group coaching calls

3. Eligibility

To use our Service, you must:

• Be at least 16 years old (or the age of digital consent in your jurisdiction if higher)
• Have legal capacity to enter into a binding agreement
• Not be prohibited from using the Service under applicable laws

By using the Service, you represent and warrant that you meet these eligibility requirements.

4. Account Registration

To access certain features of the Service, you must register for an account. When you register, you agree to:

5. ADHD Harmony Program

5.1 Program Access

Access to the Harmony AI platform and ADHD Harmony program features is provided based on your membership level. Features and access may vary based on your subscription.

5.2 Lifetime Access

Where "lifetime access" is offered, this means for as long as the program and platform exist in their current or substantially similar form. We reserve the right to modify, update, or discontinue features with reasonable notice.

5.3 Refund Policy

We offer a satisfaction guarantee for our program. If you complete the program as directed and don't feel it brought you value, you may request a refund within the guarantee period stated at purchase. 6. AI Service Terms

6.1 Nature of AI Assistance

Our AI agents provide:

• Information about ADHD and related topics

6.2 AI Limitations

You acknowledge and agree that:

• AI responses are generated by machine learning models and may not always be accurate, complete, or appropriate
• AI cannot replace professional medical, psychological, or legal advice
• AI responses are for informational and coaching purposes only
• You should independently verify any important information provided by AI
• AI performance may vary and is not guaranteed

6.3 No AI Training on Your Data

We do not use your personal data, conversations, or uploaded content to train AI models. Your data is processed solely to provide you with responses and features. See our Privacy Policy for details.

6.4 Content Moderation

Our AI includes safety measures and will not provide harmful content, medical prescriptions, or encourage dangerous activities. The AI may decline to respond to certain requests.

7. Third-Party Integrations

The Service offers optional integration with third-party services, including Google Tasks and Google Calendar. By connecting these services:

• You authorize access: You grant us permission to access and use data from these services as described in our Privacy Policy
• Third-party terms apply: Your use of third-party services is governed by their respective terms and privacy policies

9. Intellectual Property

The Service and its original content, features, and functionality are owned by ADHD Harmony and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws. This includes:

• The Harmony AI platform and its design
• AI agent personas, prompts, and frameworks
• Educational content and program materials
• Logos, branding, and visual assets

9.2 Your Content

You retain ownership of any content you submit, post, or display through the Service ("Your Content"), including:

• Documents you upload to your library
• Notes and reflections you create
• Messages you send to AI agents
• Check-in and worksheet responses

By submitting Your Content, you grant us a worldwide, non-exclusive, royalty-free license to use, reproduce, and process Your Content solely for the purpose of providing and improving the Service.

9.3 AI-Generated Content

Content generated by our AI in response to your inputs may be used by you for personal purposes. You may not claim ownership of or copyright in AI-generated content or use it for commercial purposes without our consent.

10. Health Disclaimer

10.1 Not Medical Advice

The Service:

• Does NOT provide medical advice, diagnosis, or treatment
• Is NOT a substitute for professional medical care, mental health treatment, or therapy

We do not warrant that:

• The results obtained from using the Service will be accurate or reliable
• AI responses will be accurate, complete, or appropriate for your situation
• Any errors in the Service will be corrected
• Third-party integrations will function without interruption

13. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, ADHD HARMONY SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

• Your use of or inability to use the Service
• Any unauthorized access to or use of our servers or your personal information
• Any interruption or cessation of transmission to or from the Service
• Any bugs, viruses, or other harmful code transmitted through the Service
• Any errors, inaccuracies, or omissions in AI-generated content
• Any actions taken or not taken based on Service content or AI responses
• Third-party service interruptions or failures

OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE SERVICE IN THE 12 MONTHS PRECEDING THE CLAIM, OR €100, WHICHEVER IS GREATER.

Some jurisdictions do not allow limitation of liability for certain damages. In such jurisdictions, our liability is limited to the extent permitted by law.

14. Indemnification

You agree to defend, indemnify, and hold harmless ADHD Harmony and its officers, directors, employees, contractors, and agents from and against any claims, liabilities, damages, losses, costs, and expenses (including reasonable legal fees) arising out of or in any way connected with:

• Your access to or use of the Service
• Your violation of these Terms
• Your violation of any third-party rights
• Your Content uploaded or submitted to the Service
• Your misuse of AI features or outputs

15. Termination

15.1 Termination by You

You may delete your account at any time through your account settings or by contacting us at info@adhdharmony.com.

15.2 Termination by Us

We may terminate or suspend your account and access to the Service immediately, without prior notice or liability, for any reason, including if you breach these Terms.

15.3 Effect of Termination

Upon termination:

• Your right to use the Service will immediately cease
• We may delete your account data in accordance with our Privacy Policy
• Provisions that by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, indemnity, and limitations of liability

16. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of any changes by:

Any disputes arising under these Terms shall first be attempted to be resolved through good faith negotiations. If resolution cannot be reached within 30 days, disputes shall be submitted to the competent courts of the Netherlands.

17.3 EU Consumer Rights

If you are an EU consumer, you benefit from mandatory consumer protection provisions of your country of residence. Nothing in these Terms affects your statutory rights as a consumer.

17.4 Severability

If any provision of these Terms is held to be unenforceable or invalid, such provision will be modified to the minimum extent necessary, and the remaining provisions will continue in full force and effect.

17.5 Entire Agreement

These Terms, together with our Privacy Policy and Cookie Policy, constitute the entire agreement between you and ADHD Harmony regarding the Service.
